An underride accident is a type of truck accident where a car or other standard passenger vehicle collides with a commercial truck and all or part of the vehicle goes under the rear or side of the commercial truck. Sometimes they occur when a commercial truck driver backs their truck up without realizing that there is a car behind the truck, causing the rear of the truck’s trailer to collide with and pass over the car. Underride accidents can also happen when a truck driver merges into another lane without realizing that a car is already in that lane, causing the car to go under the side of the truck’s trailer. Many times, these accidents are the result of distracted driving, fatigued driving, or driving while intoxicated.

Under the doctrine of vicarious liability, trucking companies can be held responsible for the actions of their drivers that occur within the course and scope of the driver’s employment.
