Burns cause damage to bodily tissues. They may be caused by heat, electricity, chemicals, radiation, or sunlight. Commonly, they result from building fires, hot liquids, and flammable gases. They may cause swelling, scarring, blistering, shock, infections, or death. Burns are typically divided into three types: first degree, second degree, and third degree. Third-degree burns are the most severe, destroying the deepest layer of skin and tissues. A first-degree burn may often heal on its own, but second- and third-degree burns warrant immediate medical treatment. When you first sustain or notice a burn injury, it is important to take photographs, regardless of the degree. At Nahon, Saharovich & Trotz, our Memphis burn injury lawyers can help you seek compensation if you were hurt in an accident caused by someone else. We have 33 experienced attorneys with excellent credentials and over 100 staff members, making us the largest personal injury firm based in Tennessee.

Bringing a Burn Injury Claim

Burns are extremely painful and may be expensive to treat. Often, the only way that a burn injury victim can afford the care and surgeries that may be necessary after suffering third-degree burns is by bringing a personal injury lawsuit in civil court.

In most cases, you may recover damages for burn injuries if you were harmed through the fault of another person or entity. For example, if you were burned in a car fire due to a defective engine, you may have grounds to bring a product liability lawsuit against the manufacturer or a lawsuit based on negligence against an automobile repair shop.

What you will need to establish depends on the theories that you are using to build your burn injury lawsuit. A manufacturer that sold a car with a defective engine may be held strictly liable. This means that you would need to prove that the engine had a defect, and the defective engine caused you to suffer burn injuries. However, if you bring a lawsuit based on a repair shop’s negligence, you will need to establish the duty of care owed by the repair shop, a breach of that duty, causation, and damages.

Once you establish liability, you may recover compensatory damages for your losses. These are economic and noneconomic damages that are intended to make you whole or put you in a position as close as possible to where you were before the incident. They may include medical expenses, lost income, lost earning capacity, pain and suffering, mental anguish, loss of consortium, and scarring and disfigurement. Medical expenses will vary depending on how serious your burns are. For the most serious burns, doctors may recommend skin grafts and surgical procedures to resurface your skin. These are both painful and expensive. It also may be possible to recover compensation for future medical expenses. If you were in a career that involved your physical appearance prior to suffering burns, such as modeling or acting, you may have significant lost earning capacity.

Noneconomic damages like pain and suffering or scarring may vary considerably, depending on which losses a jury believes would naturally flow from a case like yours. Burns tend to be quite painful, so it is important to present testimony on your pain and the activities that you were not able to do as a result of the pain.
