Consumer Protection Lawyers Helping Injured Victims

Direct and excessive exposure to the sun can lead to unwanted conditions like skin cancerSunscreen is an effective way of protecting the skin and preventing conditions like melanoma from appearing. People around the world rely on sunscreen to protect them from skin cancer, but recent studies suggest certain sunscreen products may cause unintended harm including leukemia, lymphoma, and other types of blood cancerNahon, Saharovich & Trotz is currently investigating claims on behalf of individuals who used recently recalled sunscreen products and later developed leukemia, lymphoma, and other forms of blood cancer. If you used Johnson & Johnson’s Neutrogena or Aveeno sunscreen spray and have been diagnosed with leukemia or cancer, contact us at 800-529-4004 for a free legal consultation.

What Is Benzene and Does It Cause Cancer?

Benzene is a human carcinogen. This means it is a substance that can cause cancer, depending on the level of exposure. Humans are exposed to benzene in a variety of settings, including cigarette smoke, car exhaust, and factory emissions. Benzene is also found in products such as gasoline and paint thinners. The National Cancer Institute states “exposure to benzene increases the risk of developing leukemia and other blood disorders.”

Does Neutrogena Sunscreen Cause Cancer?

Valisure, an independent laboratory, performed testing on a variety of sunscreen products and found many contain benzene. Johnson & Johnson, the manufacturer of Neutrogena and Aveeno sunscreen products, announced that while benzene is not an active ingredient of its sunscreen products, benzene was discovered in samples of some of their products. Sunscreen products that contain benzene can cause cancer and blood disorders. While J&J says benzene exposure at the levels detected in their products is “not expected to cause adverse health consequences,” medical experts from around the country have stated there is no safe level of benzene that can exist in sunscreen products and that daily exposure to benzene in sunscreen can cause cancer.

Which Sunscreen Products Have Been Recalled?

On July 14, 2021, Johnson & Johnson recalled the following aerosol sunscreen products due to levels of benzene detected:

  • Neutrogena Beach Defense aerosol sunscreen
  • Neutrogena Cool Dry Sport aerosol sunscreen
  • Neutrogena Invisible Daily defense aerosol sunscreen
  • Neutrogena Ultra Sheer aerosol sunscreen
  • Aveeno Protect + Refresh aerosol sunscreen

J&J’s recall notice urges consumers who are using the above aerosol products to stop using them immediately. The recalled sunscreen products were sold at pharmacies, grocery stores, and retailers throughout the country, including Walgreens, CVS, Kroger, Publix, and Costco. Johnson & Johnson has notified their retailers and distributors of this recall, and many retailers have notified customers if they purchased sunscreen that has been recalled due to safety risks.

Sunscreen Cancer Lawsuits

Lawsuits have already been filed against Johnson & Johnson alleging that Neutrogena and Aveeno aerosol sunscreen can cause medical conditions such as leukemia, myeloma, and lymphoma. It is expected that more lawsuits will be filed in the future, and injury claims may end up consolidated in federal court as part of a Multi-District Litigation (MDL). When a federal MDL is formed, plaintiffs retain their individual case (unlike a class action) but common issues such as discovery are consolidated for the purpose of efficiency and judicial economy.

A sunscreen cancer lawsuit can contain the following theories of liability against Johnson & Johnson, Neutrogena, and Aveeno:

  • Defective design of the product
  • Manufacturing defect
  • Failure to warn consumers
  • Fraudulent concealment of known risks
  • Failure to conduct proper testing
  • Breach of warranty
  • Negligent misrepresentation
  • Fraudulent misrepresentation

If you used a recalled sunscreen and now have leukemia or another blood cancer, you should call an attorney immediately. If possible, you should preserve the bottles of sunscreen that you purchased and used, as well as receipts. All product liability cases have a statute of limitations in which the claim must be filed, or the claim will be forever barred. You could be entitled to financial compensation for:

  • Medical bills, including cancer treatment, chemo, and radiation
  • Hospital costs
  • Lost wages
  • Future loss of income if you are unable to return to work
  • Pain and suffering

If your loved one passed away from leukemia but used Neutrogena or Aveeno sunscreen, the claim can be brought by his or her heirs, such as the surviving spouse, children, or parents. This is known as a wrongful death claim, and additional damages can be recovered including loss of consortium. Our product liability lawyers can explain your legal rights as well as the best avenue to pursue your claim.
