Speeding Truck Accidents

Motor Vehicle Collision Lawyers Serving Memphis and the Surrounding Areas

If you have been involved in a crash as a result of a commercial truck driver’s speeding, then you need to act quickly to protect your interests and make sure that all evidence helpful to your case is properly preserved. Most commercial vehicles have “black boxes” or other recording devices that may contain important details regarding a speeding truck accident, such as the speed upon impact. Accident reconstruction experts can also usually determine the speed at which a big truck was traveling at the time of an accident. The Memphis truck accident attorneys at Nahon, Saharovich & Trotz have the resources to retain experts and investigators to gather the evidence needed to assert a convincing case against speeding truck drivers and their employers. With over 30 attorneys and 100 staff members, we are the largest plaintiff’s accident law firm based in Tennessee, with multiple offices to effectively represent you.

Holding a Driver Liable for Accidents Involving Speeding Trucks

Truck drivers usually get paid by the mile or the load, and large trucking companies often pressure them to get to their destinations as quickly as possible. In many cases, truckers drive in excess of the speed limit in order to earn a larger paycheck and to keep their employers happy. Since tractor trailers and 18-wheelers weigh tens of thousands of pounds, it is harder for them slow down or come to a stop as quickly as other vehicles, thereby leading to more speeding truck accidents. It is also more difficult to steer and make turns in big trucks, meaning that rolling over or losing control of the big rig is more common than in regular vehicles. Speeding increases the likelihood of an accident, and when truck drivers speed serious crashes with serious injuries often result.

Tennessee recognizes the doctrine of negligence per se (or negligence as a matter of law). Negligence per se is when an act is considered to be negligent merely because it violates a law. An injured party may recover under the doctrine of negligence per se when these three elements are established, pursuant to Tennessee law:

  1. The defendant must have violated a statute or ordinance that imposes a duty or prohibition for the benefit of a person or the public;
  2. The injured party must be within the class of persons intended to benefit from or be afforded protection by the statute or ordinance; and
  3. The injured party must show that the negligence was the proximate cause of his or her injuries.

Generally, when a truck driver drives in excess of the posted speed limit and that leads to a motor vehicle crash with injuries, then the injured party may be able to seek compensation for medical expenses, pain and suffering, property damage, and lost income from the truck driver and/or the trucking company under the doctrine of negligence per se.
