May 2021 Update – Good News for Roundup Victims
A federal judge rejected Bayer’s proposed $2 billion future claims proposal. Previously, Bayer agreed to set aside nearly $10 billion to settle existing Roundup claims filed by users who alleged Roundup caused them to develop cancer. Bayer wanted to set aside an additional $2 billion for future claimants. If approved, the amount of compensation available to Plaintiffs would have been capped, and they would not be able to pursue punitive damages. U.S. District Judge Vince Chhabria in San Francisco, the presiding Judge of the Roundup Multidistrict Litigation (MDL), rejected the proposal, calling it “clearly unreasonable.” In light of the court’s ruling, victims of Roundup can continue bringing claims against Bayer in pursuit of their damages including medical bills, lost wages, and pain and suffering. NST Law is a large firm that knows how to and is ready to pursue Roundup claims. For a free consultation with our Roundup attorneys today, call NST Law at 800-529-4004.
What Is Roundup, and Who Can It Negatively Affect?
Roundup weed killer was first created over 50 years ago by the company Monsanto. The main ingredient of this weed killer is glyphosate, and unlike other herbicides, glyphosate kills any type of plant that it comes into contact with. Glyphosate has been linked with carcinogenic (cancerous) properties.
For decades, thousands of Americans in the forestry, lawn care, and agriculture industries have used Roundup as part of their daily work routine. In addition to being used in commercial settings, such as farms, Roundup is commonly used at private homes and gardens. Those most at risk for developing non-Hodgkin’s lymphoma from Roundup use include:
- Commercial farmers
- Landscapers – commercial or private
- Agriculture workers
- Nursery employees
Scientific Link Between Roundup and Non-Hodgkins Lymphoma
Non-Hodgkin’s lymphoma, also known as NHL, is a form of cancer that starts in white blood cells called lymphocytes. They are part of the human body’s immune system, which helps the body fight diseases and infections. Non-Hodgkin’s lymphoma can be found anywhere in the body that has lymph tissue, including the lymph nodes, spleen, bone marrow, thymus, adenoids, tonsils, and digestive tract. In terms of developing this type of cancer, doctors state environmental factors play a large role.
There are two types of non-Hodgkin’s lymphoma. Either type can spread slowly or aggressively.
- B-cell lymphoma (B cells produce antibodies, which protect the body against bacteria and germs) – the most common form of non-Hodgkin’s lymphoma
- T-cell lymphoma (T cells help destroy germs and abnormal cells)
Our Roundup attorneys are aware that recent studies have expounded upon the carcinogenic properties of Roundup and linked the product to certain forms of cancer, mainly non-Hodgkin’s lymphoma. In 2015, the World Health Organization’s International Agency for Research on Cancer (IARC) released a report stating glyphosate is “probably carcinogenic to humans,” and a recent study published by Science Direct found that people exposed to glyphosate herbicides can have a 41% higher chance of developing non-Hodgkin’s lymphoma. Monsanto, on the other hand, alleges the product is safe and has met all guidelines set forth by the Environmental Protection Agency (EPA).
Roundup Cancer Lawsuits
Currently, there are more than 10,000 pending Roundup lawsuits against Monsanto in various state and federal courts. Lawsuits filed by people across the United States have alleged that Monsanto engaged in false advertising by claiming, for years, that the product was completely safe to use and failed to properly warn consumers about the potential side effects of using Roundup. Of course, the company has disputed those allegations, and as a result, these lawsuits have become highly contested in court. There have been several recent large jury verdicts in Roundup litigation, including verdicts for $80 million, $289 million, and $2 billion.
If you or a loved one developed non-Hodgkin’s lymphoma, you understand the toll it can take – physically, emotionally, and financially. People who suffer from cancer caused by Roundup use can pursue legal action for their losses, including medical bills, cancer treatment such as chemotherapy, lost wages, pain and suffering, and loss of enjoyment of life. If the victim passed away, a wrongful death claim can be pursued in court. In addition to recovering compensatory damages, victims may be entitled to punitive damages, which are a special class of damages designed to punish a defendant for egregious conduct, such as knowingly hiding risks of using a consumer product from prospective users.
The success of a lawsuit brought by victims and their Roundup lawyers can depend largely on expert witnesses. Monsanto and Bayer are denying all wrongdoing in these cases, but expert doctors and researchers have found links between Roundup and non-Hodgkin’s lymphoma. In your case, medical experts and qualified scientists can review medical records and studies to determine if a causal link between Roundup and the diagnosis exists. Expert witnesses can also testify about the cost of future medical treatment needed or a victim’s loss of income. Our law firm has the experience and resources to consult with qualified experts in order to properly pursue your product liability case.
